Charities Fund Raiser and State Reach Settlement
NEWARK - An Ocean-County based independent paid fund raiser that solicited donations for charitable organizations has agreed to pay a civil penalty and to comply with applicable state laws and regulations, under a Consent Order reached with the Division of Consumer Affairs.
New Liberty Promotions, Inc., of Brick, which also does business as Donation Processing Center of New Jersey; Police Defense Foundation; and Public Awareness Center and its owner, Glenn Nowland, will pay $7,500 as a civil penalty for violating the state’s Charities Registration and Investigations Act and Regulations Governing Charitable Fundraising. An additional $7,500 penalty is suspended but will be enforced if the respondents violate any terms of the Consent Order within the next three years.
Additionally, Nowland agreed to comply with the state’s applicable laws and regulations in operating a new independent fund raiser that he is establishing – Capital Assistance, LLC, which will do business as Community Awareness Center.
“The public wants to know how much of the monies it donates to a charity actually ends up with the charity and how much is paid to the fund raiser. This Consent Order, with its requirements for the filing of contracts and fund-raising campaign reports with the Division, ensures that this information is available to the public,” said Sharon Joyce, Acting Director of the Division of Consumer Affairs.
The respondents have represented to the Division that New Liberty Promotions is no longer doing business in New Jersey. Nowland is required for the next five years to inform the Division of any changes in his business status, including the creation of new independent paid fund raisers.
